Terms of Use

Introduction

These Terms of Use (“Terms”) govern your access to and use of the Caveryn website at www.caveryn.com and the Caveryn web application at app.caveryn.com (collectively, the “Service”). By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using Caveryn, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree that:

  • You use the Service at your own risk.
  • Caveryn is not responsible for unauthorized access resulting from your failure to safeguard credentials.
  • We may suspend or terminate accounts at our sole discretion.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, harmful, abusive, or fraudulent purpose.
  • Upload or transmit malicious code.
  • Interfere with the operation or security of the Service.
  • Attempt to access systems or data you are not authorized to access.
  • Use the Service in a way that creates legal exposure for Caveryn.

We reserve the right to investigate, restrict, suspend, or terminate access without notice.

4. User Content

You retain ownership of content you create (“User Content”). However, by submitting User Content, you grant Caveryn an irrevocable, non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, and display such content for any purpose related to operating, maintaining, improving, or protecting the Service.

You represent and warrant that:

  • You have all rights necessary to submit the content.
  • Your content does not violate any laws or third-party rights.

Caveryn is not responsible for loss, deletion, corruption, or unauthorized access to User Content.

5. Paid Features and Billing

Caveryn may offer paid features or subscriptions.

  • All fees are non-refundable, except where required by law.
  • We may change pricing or features at any time.
  • We are not responsible for errors caused by third-party payment processors.
  • Failure to pay may result in immediate suspension or termination of access.

6. Intellectual Property

All rights, title, and interest in the Service (excluding User Content), including software, branding, design, and functionality, are owned by Caveryn. No rights are granted except as expressly stated in these Terms.

7. Termination and Suspension

We may suspend or terminate your access to the Service:

  • At any time
  • For any reason or no reason
  • With or without notice

Upon termination, we may delete your account and associated data without liability.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAVERYN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • AVAILABILITY, SECURITY, OR ACCURACY

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Caveryn shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. This includes loss of data, profits, business, goodwill, or use—even if we have been advised of the possibility of such damages.
  • In all cases, Caveryn’s total liability shall not exceed the amount you paid to Caveryn in the twelve (12) months prior to the claim, or $50 USD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Caveryn from any claims, damages, liabilities, losses, or expenses arising out of:

  • Your use of the Service
  • Your content
  • Your violation of these Terms

11. Changes to These Terms

We may modify these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.
